Terms and Conditions – EV Electric

These Terms and Conditions apply to all services provided by EV Electric (“we,” “us,” or “our”) to any customer (“you” or “the Client”). By requesting services, accepting an estimate or quote, or allowing work to proceed, you agree to these terms.

1. Services

EV Electric provides residential, commercial, and related electrical services in Manitoba, including but not limited to installations, repairs, upgrades, inspections, and maintenance.

All work is performed in accordance with applicable Canadian Electrical Code and local authority requirements.

2. Estimates and Quotes

  • Estimates are non-binding and subject to change based on site conditions, code requirements, and material availability.
  • Written quotes are valid for a limited time and may be revised if conditions differ from what was originally disclosed or visible.
  • Any additional work not included in the original quote will require a change order and may result in additional charges.

3. Payment Terms

  • Payment is due upon completion unless otherwise agreed in writing.
  • Deposits may be required for larger projects or special-order materials.
  • Invoices not paid when due may be subject to interest and collection costs.
  • We reserve the right to suspend work for non-payment.

4. Access and Site Conditions

You agree to provide safe, clear, and timely access to the work area, electrical panels, and related equipment.

We are not responsible for:

  • Hidden or pre-existing defects
  • Unsafe wiring installed by others
  • Asbestos, mold, or hazardous materials
  • Structural or cosmetic damage required to access concealed wiring

5. Permits and Inspections

Where required, permits will be obtained and inspections arranged. Final approval is subject to the Authority Having Jurisdiction. We are not responsible for delays caused by inspectors, utilities, or permit offices.

6. Delays and Force Majeure

We are not liable for delays caused by circumstances beyond our control, including but not limited to:

  • Weather
  • Supply chain shortages
  • Utility outages
  • Labor issues
  • Government or inspection delays

7. Warranties

  • Workmanship is warranted in accordance with Manitoba law.
  • Equipment and materials are subject to the manufacturer’s warranty only.
  • We are not responsible for failures caused by misuse, modification, power surges, or work performed by others.

8. Limitation of Liability

To the maximum extent permitted by law:

  • EV Electric shall not be liable for indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the value of the services provided.
  • We are not responsible for damage to existing finishes, landscaping, or concealed components unless caused by gross negligence.

9. Photos and Documentation

We may take photos or videos of job sites for documentation, training, warranty, or marketing purposes. Identifying information will not be published without consent.

10. Governing Law

These terms are governed by the laws of the Province of Manitoba and the laws of Canada applicable therein.

11. Dispute Resolution

Any dispute shall first be attempted to be resolved in good faith between the parties. If unresolved, the matter shall be brought before the courts of Manitoba.

12. Termination

We reserve the right to refuse or terminate service for unsafe conditions, non-payment, abuse, or illegal activity.

13. Entire Agreement

These Terms and Conditions, together with any written estimate or contract, constitute the entire agreement between the parties.
